Agreement to Terms

By accessing or using the blissful-pines website (the "Site") and services, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page with an updated revision date. Your continued use of the Site after changes are posted constitutes your acceptance of the modified Terms.

Unless otherwise indicated, the Site and all content, features, and functionality (including but not limited to text, graphics, logos, images, and software) are owned by blissful-pines or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Indigenous Cultural Content

Certain content on this Site, including stories, teachings, and cultural information, is shared with permission from Indigenous knowledge keepers and communities. This content is protected not only by intellectual property law but also by Indigenous cultural protocols and rights.

You may not reproduce, distribute, modify, create derivative works from, or publicly display this cultural content without express written permission from both blissful-pines and the relevant Indigenous communities.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. This license does not include the right to:

• Reproduce or copy materials from the Site
• Sell, license, or otherwise commercialize materials from the Site

Programs and Services

Enrollment

When you enroll in one of our programs, you enter into a separate agreement for services. Program-specific terms, cancellation policies, and payment terms will be provided at the time of enrollment.

Pricing

All prices are listed in Canadian dollars (CAD) and are subject to change without notice. We reserve the right to modify pricing for future program offerings.

Payment

Payment terms will be specified in your program enrollment agreement. Generally, payment is required in advance of program delivery unless alternative arrangements have been made.

Cancellation and Refunds

Cancellation and refund policies vary by program type and will be outlined in your enrollment agreement. Generally:

• Cancellations made more than 30 days before a program may receive a full refund minus an administrative fee
• Cancellations made 15-30 days before a program may receive a 50% refund
• Cancellations made less than 15 days before a program are generally non-refundable

We reserve the right to cancel programs due to insufficient enrollment or unforeseen circumstances, in which case full refunds will be provided.

Third-Party Links

The Site may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of these external sites. Your use of third-party websites is at your own risk and subject to their terms and conditions.

Disclaimers

Educational Purpose

The content on this Site is provided for educational and informational purposes. While we strive to provide accurate and up-to-date information about Indigenous cultures and histories, we do not claim comprehensive or authoritative knowledge. Indigenous cultures are diverse, and teachings vary across Nations and communities.

No Warranties

The Site and all content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Site will be uninterrupted or error-free
• Defects will be corrected
• The Site or servers are free of viruses or harmful components
• The results of using the Site will meet your requirements

Limitation of Liability

To the fullest extent permitted by law, blissful-pines, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from:

• Your access to or use of (or inability to access or use) the Site
• Any conduct or content of third parties on the Site
• Unauthorized access, use, or alteration of your content
• Any other matter relating to the Site or services

Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, or CAD $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless blissful-pines and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

• Your access to or use of the Site
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights

Cultural Respect and Protocols

By using our Site and services, you agree to approach Indigenous cultures, histories, and teachings with respect. This includes:

• Not appropriating or misrepresenting Indigenous cultural practices
• Not sharing sacred or restricted knowledge obtained through our programs without permission
• Recognizing the diversity of Indigenous Nations and avoiding generalizations
• Supporting Indigenous communities and sovereignty

Violations of cultural protocols may result in termination of your access to our services.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in Victoria, British Columbia.

Dispute Resolution

Before filing a legal claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We are committed to working with you in good faith to reach a mutually acceptable resolution.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of blissful-pines.

Entire Agreement

These Terms, together with our Privacy Policy and any program-specific agreements, constitute the entire agreement between you and blissful-pines regarding your use of the Site and supersede all prior agreements and understandings.
